It's important to note that only one party needs to want the divorce and you can apply either jointly or on your own behalf. In most cases, your ex-partner cannot oppose a request for divorce, except under very specific circumstances. If you have been married for less than two years, you will need to file a counselling certificate.

At times, couples may separate while still living together under the same roof. It is possible to apply for a divorce in this situation, as long as there is evidence to show that the couple lived and slept separately, did not carry out domestic chores for each other, separated their finances, did not socialise together, and the public perception was that they were in fact separated.
